The instructor of the Supreme Court makes this decision once the deadline to file an appeal against the sentence adopted on July 5, 2023 by the General Court of the European Union (TGUE) which ratified the decision of the European Parliament to grant the request against both and, therefore, to withdraw their immunity.

Last Friday, Puigdemont and Comín appealed to the CJEU against the decision of the General Court of the EU to withdraw their immunity as MEPs, but they have not yet presented precautionary measures to suspend this ruling.
