BUSINESS INFO – PT Pegadaian was sued in May 2022 for alleged copyright infringement on the Gold Savings product. The value of the lawsuit reached IDR 322.5 billion. This lawsuit was filed by Arie Indra Manurung with Case Number: 40/Pdt.Sus.HakCipta/2022/PN.Niaga.Jkt.Pst which was registered on May 10, 2022.
After going through the trial process, the Panel of Judges of the Commercial Court at the Central Jakarta District Court chaired by Muhammad Yusuf, SH, MH, Tuesday, September 6, 2022 finally decided on the case for the Lawsuit for Copyright Infringement of Tabung Emas whose verdict stated that the Plaintiff’s Lawsuit was Rejected in Entire and Charged Cost of Case to Plaintiff.
Arie then filed an appeal to the Supreme Court of the Republic of Indonesia. In February 2023, the Supreme Court of the Republic of Indonesia rejected Arie Indra Manurung’s cassation request and ordered the Cassation Petitioner to pay court costs at cassation level.
VP Corcomm PT Pegadaian Basuki Tri Andayani said, the Gold Savings product was officially launched by President Joko Widodo on July 5 2015. The operation of the Gold Savings product has also obtained a permit from the Financial Services Authority (OJK) with letter number S-427/NB.11/ 2016 dated 17 February 2016.
“In the context of structuring the Pawn Industry, on July 28 2016 OJK issued OJK Regulation 31 of 2016 concerning Pawn Business. As a Financial Services Institution that complies with regulations, Pegadaian also carries out business restructuring.
One of them is by establishing a subsidiary called Galeri 24 which focuses on handling the gold business,” said Basuki.
Pegadaian, he continued, also submitted a renewal of the Gold Savings operational permit which was granted by the OJK with letter number S-476/NB.111/2019 dated October 9 2019 regarding PT Pegadaian (Persero) Gold Savings Products Approval.
In line with the transformation program, Pegadaian on April 1 2018 launched the Pegadaian Digital application. With this application, it is easier for people to access Gold Savings products without having to come to a Pegadaian outlet, but transactions can be made anytime and anywhere as long as there is an adequate internet network.
Pegadaian’s victory over the cassation further strengthens Pegadaian as a Financial Services Institution that is managed according to the principles of Good Corporate Governance (GCG).
“In this way, stakeholders, especially customers, no longer need to hesitate to continue making transactions and conducting business interactions with Pegadaian. The company’s products and services, before being launched to the public, always go through various studies, such as comprehensive legal, business, risk and other studies,” said Basuki.
