The U.S. Federal Court of Appeals on Friday overturned the death penalty for Dochar Carnajev, who was convicted of running to the Boston Marathon in April 2013, in which the people died and 260 others were injured. Reuters reported.

The appellant upheld the points in which Carnaev was convicted, but urged that a new trial be held, where only the sentence would be decided. According to Reuters, Carnaev did not comment on the first decision of the federal court.

Rogeriee Thompsonov stated in a new report that the judge made a mistake in the selection of the jury, as he did not ensure that his members were not affected by the publicity that the case was supposed to go to before the court was arrested.
