Nord Stream 2 Executive Director Matthias Warnig sent a letter to the President of the European Commission (EC) Jean-Claude Juncker, according to a politician, who published a copy of the document. Warnig threatened the EC with legal proceedings if, due to the new regulatory rules, the Nord Stream II project was interrupted.
In his letter, Warnig drew attention to the EU gas directive, which, according to Nord Stream 2, threatens investors' interests in the pipeline project. In accordance with this directive, Gazprom will not be able to be both a pipeline owner and a resource provider. Access to the Nord Stream-2 must be received by other companies.
The construction of the pipeline, according to Warnig, will have a beneficial effect on the entire economy of the EU: the project will give 31,000 jobs to Europeans and will add 5 billion euros to gas supplies from the EU. supply of gas along the second line of Nord Stream can reduce the price of this type of fuel by 13% by 2020. Warnig draws Juncker's attention to the fact that the implementation of the project began several years ago and was carried out based on the then existing regulations for the regulation of the gas sector. Since 2015, Nord Stream 2 AG has already invested 5.8 billion euros in the project.
According to Warnig, an exception should be made for the Nord Stream 2 gas directive. Otherwise, the EU risks violating the Energy Charter. To do this, the European Union must recognize that at the time of the entry into force of the Gas Directive in the summer of 2019, Nord Stream II can be considered an existing gas pipeline. Furthermore, Warnig himself admits that in reality the pipeline will not be commissioned by the summer.
If the EU does not accept the terms of Nord Stream 2, the company intends to protect the interests of investors pursuant to art. 26 of the Energy Charter. This article provides for the resolution of disputes through the courts.
