Megawati’s proposal was problematic. As mentioned by Mardani, from a philosophical point of view, this proposal creates a treatment gap between the old parties and the newcomer parties in the 2024 General Election.

So far, there are 24 political parties that have passed the registration stage for candidates for election participants and their files are being verified by the General Elections Commission (KPU).

Nine of them are parties that will make their debut in the contest, so they have never had a serial number.

One of them is the Ummah Party. The party created by Amien Rais strongly criticized Megawati’s discourse regarding the abolition of the serial number drawing.

According to Ninis, Megawati’s proposal could cause injustice for parties that have just attended the 2024 general election.

“For the realization, maybe it can be checked with the KPU, because later the KPU will make the technical rules. However, all this time, the technical regulations have always had this lottery process. If this rule is implemented, it will certainly benefit the old party,” he said.

Revision of regulations?

Another problem with Megawati’s proposal is that this discourse violates Law Number 7 of 2017 concerning Elections, in particular Article 179 which clearly mandates the issue of drawing the serial numbers of election participants openly.

In the RI KPU Regulation Number 4 of 2022 concerning the registration, verification, and determination of participants in the 2024 Election, the RI KPU also includes this provision in Article 137.

However, the Indonesian KPU admits that it does not rule out the possibility of revising this serial number, although to do so, the Election Law and KPU Regulation Number 4 of 2022 need to be revised as well. The suggestion regarding this serial number is claimed to be a valid input to be considered.

“In carrying out the election, the KPU wants to realize a participatory election marked by a deliberative space for stakeholders, civil society, and activists as well as the general election to provide input to the KPU RI,” said the Coordinator of the Technical Division for the Election of the KPU RI, Idham Holik, to Kompas.comMonday (19/9/2022).

“The KPU really appreciates all parties who have provided input or suggestions so that the technical arrangements or policies for the implementation of elections will be even better,” he said.

In other words, the proposals put forward by Megawati were considered as inputs. KPU RI will conduct a special study to consider it.

“I will propose to the plenary meeting and the Chairman of the KPU RI (Hasyim Asy’ari) has also said that he will discuss it internally first,” said Idham.

“The input is considered and will be proposed to be discussed internally by the KPU first before being consulted with the DPR and the government, as stated in Article 75 paragraph 4 of Law Number 7 of 2017 (regarding the General Election),” he continued.

However, the KPU’s stance has drawn criticism from Perludem. EMBs are asked to be consistent with the schedule of stages that have been standardized in their own regulations.

Megawati was also criticized for submitting a proposal that was deemed non-substantive when the 2024 election stage had already begun.

“One of the main characteristics of the process of organizing a democratic election is that all stages are definite and do not change. If the stages are changed, changes will be made in the middle of the road. especially for things that are actually not substantial, it will disrupt confidence in the regularity of the stages of the election that have been arranged in a cycle,” said Needdem researcher, Fadli Ramadhanil, Monday.

“The stages of the election being discussed, which are currently being carried out, have been discussed at length by the political parties in the DPR, by the government, and also by the KPU. PDI-P is one of the parties involved in discussing the stages of this election with the KPU. This should have been completed when discussion on the design of the last (election) stage,” he said.
