Data indicates that e-cigarettes are now the most common entry point for nicotine use among young people, and approximately eight percent of young people consume nicotine pouches daily, according to Waltraud Posch from Vivid, a specialist center for addiction prevention, on World No Tobacco Day 2025.

This aggressive marketing was previously possible due to a loophole: these new nicotine products were not covered by the Tobacco and Non-Smoker Protection Act (TNRSG). The existing tobacco monopoly, which governs cigarettes, did not apply to nicotine pouches, vapes, and similar products. Though, on Tuesday, the Austrian federal government – comprised of the ÖVP, SPÖ, and neos parties – reached an agreement to amend the tobacco law. This amendment will extend the tobacco monopoly to include nicotine pouches and e-liquids, with the changes scheduled to take effect in July 2026.

Nicotine Pouches and E-Cigarettes Subject to Tobacco Tax

The amendment means that nicotine pouches and e-liquids – the nicotine-containing liquids used in e-cigarettes – will now only be available for purchase in licensed tobacconists. These retailers are required to enforce age controls, and the products will be subject to tobacco tax. This is expected to generate additional revenue for the government, with the Ministry of Health estimating an increase of 500 million euros.
