The British government recently unveiled two significant legislative initiatives that are intended to permanently change the country’s digital landscape. On the one hand, the new Data (Use and Access) Act makes the use of artificial intelligence (AI) in companies easier. On the other hand, the Cyber Security and Resilience Bill aims to strengthen cybersecurity and better protect critical infrastructure.

The new data law, which has been in force since February 5, allows the use of automated decision-making systems, provided appropriate safeguards are in place. This means companies can more easily integrate AI tools in areas such as financial services or healthcare. A new legal basis, the ‘recognized legitimate interests’, is also intended to facilitate certain data processing purposes such as combating crime.

At the same time, the Cyber Security and Resilience Bill is being discussed in the British Parliament. This draft provides for a comprehensive revision of the regulations in force since 2018 and is intended to extend regulation to more digital service providers. The focus is particularly on managed service providers and data centers, which have often been neglected so far. Stricter reporting requirements for security incidents and higher fines for violations are central elements of the draft.

Simultaneously promoting AI innovation and tightening cybersecurity laws illustrates the UK government’s balancing act. While the data reform is intended to exploit the economic opportunities of AI, the security law responds to the risks associated with the use of these technologies. A proposal in the cyber law would require authorized testers to check AI models for possible misuse, making the security of the models themselves a matter of national security.

For UK businesses, this means they now need to adapt to the new data regulations. The UK data protection authority ICO will play a key role in this. The Cyber Security and Resilience Bill continues to be discussed in Parliament, with industry paying particular attention to the specific obligations for service providers. Successful implementation of both laws will be crucial to whether the UK achieves its goal of becoming a global leader in AI innovation and cyber resilience.
