Sparkasse Gelsenkirchen Vault Break-In: Claims Payouts Commence After Pressure

Three months after a significant break-in at a Sparkasse branch in Gelsenkirchen, Germany, insurance payouts are commencing to affected customers. The settlement process gained momentum following sustained pressure from those impacted and their legal representatives.

The Break-In

In late December, perpetrators drilled through a wall of an adjacent parking garage to access the vault of the Sparkasse Gelsenkirchen-Buer branch. Approximately 3,250 safety deposit boxes were compromised in the heist. Initial police estimates placed the value of the stolen contents around €30 million, based on a liability limit of €10,300 per box.

Compensation and Legal Action

Lawyer Daniel Kuhlmann announced he had secured approximately €250,000 in compensation for eleven clients. He attributed this success to media engagement and the threat of legal action, emphasizing the importance of detailed inventory lists and complete proof of contents. Kuhlmann has filed model lawsuits against the Sparkasse, alleging negligence and inadequate security measures, citing a 60-page report from a banking security expert.

Liability and Insurance Challenges

A key challenge for customers lies in proving the value of items stored in their safety deposit boxes, particularly cash, jewelry, and gold. Lawyers are arguing that the Sparkasse should be held fully liable, exceeding the standard €10,300 per-box limit. Attorney Hans Reinhardt stated that the Sparkasse bears the burden of proving adequate security measures were in place, including state-of-the-art systems, regular checks, and structural integrity assessments.

Attorney Burkhard Benecken highlighted that the liability limit is often buried in the fine print of the rental agreement, and not fully discussed during the contract signing process. Witness statements can be used to demonstrate a failure by the bank to adequately inform customers of these limitations.

Court Date Set

The Landgericht Essen has scheduled the first hearing in the civil proceedings for June 11, 2026. The initial session will focus on exploring the possibility of a settlement between the affected parties and the Sparkasse.
