Essayli’s office has announced “multiple election fraud investigations” in coordination with the FBI, urging Californians to submit evidence of “potential election fraud” while pledging to “charge some people” once vote counts are certified, per a statement from his office. This approach directly conflicts with the Justice Manual, which prohibits federal prosecutors from public fraud inquiries during ongoing elections to avoid undermining voter confidence.

The Justice Manual, a binding directive for federal prosecutors, explicitly states that “overt criminal investigative measures in matters involving alleged ballot fraud” should be delayed until after elections conclude. This policy aims to prevent “chilling legitimate voting and campaign activities” and avoid interfering with election contests, according to the document.

Ciaran McEvoy, a spokesperson for Essayli’s office, declined to comment on the attorney’s actions. However, Essayli has previously acknowledged lacking evidence of widespread fraud that could alter election outcomes, as reported by The Los Angeles Times. Despite this, he has highlighted isolated incidents as potential indicators of broader issues, citing California’s resistance to a federal audit of voter rolls.

Robert Renner, who joined the office in March, visited a Los Angeles County ballot processing center to question officials about the ballot update, according to a law enforcement source. Essayli’s elevated role in Los Angeles reflects broader Trump administration efforts to appoint loyalists to key Justice Department positions. Earlier this year, a Los Angeles Times investigation revealed that disgraced prosecutor Eric Neff, who led a failed election integrity case based on “Stop The Steal” claims, was promoted to a federal voting section role.
