South Korea Strengthens Crypto Oversight Following Two Years of Market Protection Laws

South Korean financial regulators have investigated over 40 cases of unfair crypto trading since the implementation of the Virtual Asset User Protection Act on July 19, 2024. According to the Financial Services Commission (FSC), authorities have referred more than 30 of these cases to investigative agencies, identifying 25 suspects involved in market manipulation and fraudulent trading, with average illicit gains estimated at 1.4 billion Korean won ($940,000) per case.

Regulatory Enforcement Under the Virtual Asset User Protection Act

The Virtual Asset User Protection Act established a formal legal framework to bring South Korea’s crypto market under institutional oversight. The law mandates that virtual asset service providers (VASPs) maintain strict separation between customer holdings and company assets, requiring that user deposits be held in banks.

Beyond safeguarding deposits, the legislation grants the FSC authority to inspect service providers and penalize illicit activities, including insider trading, wash trading, and price manipulation. In a recent move to enforce these rules, the FSC referred two significant market manipulation cases to prosecutors. One case involved an individual trader who allegedly acquired nearly 50% of a token’s circulating supply, subsequently selling the assets into rising demand to inflate prices. To combat sophisticated trading patterns, the FSC plans to integrate artificial intelligence into its surveillance and monitoring infrastructure. South Korea is currently broadening its regulatory reach beyond the initial scope of the 2024 protection law. The government is evaluating a proposal to integrate cryptocurrencies and digital assets into a formal state asset management framework, which would apply state-level asset regulations—previously reserved for traditional holdings like real estate—to the digital sector. Simultaneously, the Financial Intelligence Unit (FIU) has intensified its pressure on unregistered entities. Regulators continue to advise users to exercise caution when interacting with platforms that operate outside the authorized registration system, emphasizing that these entities lack the oversight protections mandated by the Virtual Asset User Protection Act.
