North Rhine-Westphalia is ramping up enforcement against the illegal sale of tobacco-free nicotine pouches, deploying a new administrative order designed to bypass lengthy product testing during municipal inspections. According to the North Rhine-Westphalia Consumer Protection Ministry in Düsseldorf, the initiative gives local authorities immediate enforcement powers to seize the items from the black market and retail shelves.
New Enforcement Directive Targets Retailers and Online Sellers
Under a standardized administrative order issued by the Düsseldorf Consumer Protection Ministry, municipal enforcement officers no longer need to prove the exact chemical risk of individual products before seizing them. According to the ministry, the order establishes that a ban can be enforced immediately without waiting for detailed laboratory analysis, and legal appeals by sellers will not have a suspensory effect. Cities including Düsseldorf, Cologne, and the Unna district have already adopted these specialized local decrees to crack down on the trade.
Traders caught selling the illegal pouches face severe penalties depending on the specific case. According to the consumer protection ministry, consequences range from formal warnings and maximum fines of up to 50,000 euros to criminal penalties carrying up to one year of imprisonment.
Legal Status and Import Loophole in Germany
While European Union law generally prohibits placing tobacco-free nicotine pouches on the market without specific authorization—though some EU member states permit regulated sales—Germany classifies them strictly as novel foods rather than tobacco products. According to the North Rhine-Westphalia Consumer Protection Ministry, multiple court rulings have already confirmed this classification as a harmful, unauthorized food item.
Because consuming the products remains legal in Germany, individuals and online vendors routinely import the pouches from abroad via the internet. In addition to online orders, numerous local retail outlets, including neighborhood kiosks, sell the black-market items under the counter.
Health Risks and Appeal to Youth
Tobacco-free nicotine pouches are small cellulose packets containing nicotine, flavorings, and additives, which users place between the lip and gum to release the drug.
North Rhine-Westphalia Consumer Protection Minister Silke Gorißen noted that the diverse flavor profiles—such as mint, licorice, and fruit—make the products explicitly attractive to children, adolescents, and non-smokers. According to Gorißen, nicotine interferes directly with adolescent brain development, accelerates the onset of addiction, and causes long-term changes in the brain’s reward system and behavior, making early exposure exceptionally hazardous.
