French parking lot owners seeking an extension to mandatory solar panel installation deadlines must meet strict technical, environmental, and supply-chain criteria under Decree No. 2026-842, published on September 7, 2026. According to Arnaud Gossement, the decree builds on the framework established by Article 40 of Law No. 2023-175 of March 10, 2023, aimed at accelerating renewable energy production.
Requirements for Parking Lots Over 10,000 Square Meters
For outdoor parking facilities with a surface area equal to or exceeding 10,000 square meters, Article 1 of Decree No. 2026-842 outlines specific performance thresholds required to qualify for an installation deadline extension. Solar panels must achieve an energy efficiency value—defined as the ratio between received energy on the exposed surface and produced energy—strictly greater than 22 percent.
Additional technical criteria mandate that after the first year, the annual drop in energy efficiency must remain below 0.4 percent. The simplified carbon evaluation value of the panel cannot exceed 740 kgCO2eq/kWc. Furthermore, manufacturers must provide a product warranty covering manufacturing defects for at least 12 years, alongside a performance warranty guaranteeing that the panel will produce at least 80 percent of its nominal capacity for a minimum of 30 years.
Supply-chain rules for large parking lots dictate that module assembly must not be performed by an enterprise executing the majority of its module production in a third country that accounts for more than 50 percent of the European Union's photovoltaic panel supply.
Regulations for Medium-Sized Parking Facilities
Article 2 of Decree No. 2026-842 establishes distinct sourcing conditions for parking lots ranging from 1,500 to 10,000 square meters. While these medium-sized facilities share the same 22 percent efficiency threshold, sub-0.4 percent annual degradation rate, 740 kgCO2eq/kWc carbon ceiling, and warranty terms as larger lots, their geographic sourcing mandates differ.
For parking lots under 10,000 square meters, the module must be assembled within the European Economic Area. Additionally, the manufacturing of the individual cells must not take place in a third country that represents more than 50 percent of the European Union’s photovoltaic panel supply.
Contractual Deadlines and Recent Legislative Shifts
The regulatory landscape for parking lot solarization shifted following Article 8 of Law No. 2025-1129, enacted on November 26, 2025, which simplified urban planning and housing law. This legislation permits mixed-process installations covering at least half of a parking area, combining shade structures over at least 35 percent of that half-area with vegetated shading devices.
Property owners utilizing third-party installers must formalize their commitments within strict statutory windows. For parking facilities of 10,000 square meters or more, owners must secure an engagement contract with a deposit by June 30, 2026, and finalize a purchase order by December 31, 2026, ensuring installation is completed before January 1, 2028. For mid-sized lots between 1,500 and 10,000 square meters, the engagement contract deadline is June 30, 2027, with a purchase order required by December 31, 2027, and final installation mandated before January 1, 2030.
