Israeli President Isaac Herzog has expunged the criminal record of Elor Azaria, a former army medic convicted of manslaughter for killing an incapacitated Palestinian attacker in Hebron in 2016, according to announcements from the president’s office. The decision shortens the remaining erasure period on Azaria’s record, clearing it entirely despite formal opposition from the Israeli army.
The case dates back to March 2016, when Azaria shot Abdel Fattah al-Sharif in the head in Hebron. According to military proceedings, al-Sharif had stabbed and wounded an Israeli soldier, but had already been shot by troops and lay incapacitated on the ground for approximately 11 minutes before Azaria fired the fatal shot. A military court convicted Azaria of manslaughter in 2017, sentencing him to 18 months in prison. The sentence was later reduced to 14 months, and Azaria was released in May 2018 after serving nine months behind bars.
Military Opposition and Official Justifications
The decision to grant the pardon went forward despite explicit objections from military leadership. In a letter addressed to the defense minister, army Chief of Staff Lieutenant-General Eyal Zamir and other senior officers stated that Azaria “has refrained from expressing remorse and taking responsibility for his actions, even a decade after his conviction,” according to reports by The Times of Israel.
Conversely, the president’s office stated that it weighed the military’s position but ultimately determined that the passage of time, the completion of the sentence, and the remorse expressed warranted allowing Azaria to open a new chapter in his life. According to Al Jazeera, the pardon was issued in the spirit of Yom Kippur, the Jewish Day of Atonement, and did not alter or challenge the integrity of the original legal proceedings. The move followed a formal request submitted in July by Defense Minister Israel Katz, who welcomed the decision by posting on X that it sends an important message to soldiers and their families that the state does not abandon its fighters.
Political Reactions and International Fallout
Far-right National Security Minister Itamar Ben-Gvir called the decision “deeply moving,” according to The Jerusalem Post, while using the moment to urge Herzog to grant a similar pardon to Prime Minister Benjamin Netanyahu, who faces an ongoing corruption trial.
The original 2016 shooting and subsequent legal leniency triggered significant international criticism. At the time of the incident, the Palestinian Ministry of Foreign Affairs condemned the killing as an “extrajudicial execution” and a “war crime,” asserting that video footage of the event undermined official claims regarding military ethics. Al-Sharif’s family dismissed the initial military court proceedings as a farce intended to manage Israel’s international reputation rather than deliver genuine accountability.
International bodies also scrutinized the judicial outcome. The United Nations human rights office characterized Azaria’s original military sentence as excessively lenient, warning that it risked reinforcing a culture of impunity within the ranks. Years later, under the Joe Biden administration, the United States imposed travel restrictions on Azaria and his immediate family, barring them from entry due to involvement in an extrajudicial killing, as documented by The New York Times.
