The city of San Diego is threatening to terminate its contract with the Gaslamp Quarter Association following allegations that its executive director approved and accepted a $10,000 payment for an illegal marquee advertisement during Comic-Con. City officials issued Elevue Inc., an advertising agency working for Marvel Studios, a $160,000 fine in July for installing the unpermitted display promoting Marvel’s Avengers movie.
The Comic-Con Marquee Dispute and City Fines
The unauthorized sign remained in place for six days, accumulating daily penalties that started at $10,000 and reached a maximum of $60,000. City officials stated that warnings were issued both before and during the installation process. While temporary building wraps have frequently appeared during Comic-Con despite lacking permits, this specific display significantly exceeded previous fine amounts. It also surpassed the 11 other citations issued by the city this year, all of which totaled under $10,000. In an official statement released in July, the city emphasized that temporary additions in public rights-of-way must be installed safely, noting that the contractor knowingly created a safety risk and refused to address it.
Contract Breach Allegations and Financial Evidence
The marquee structure is owned by the city, but its maintenance is overseen by the Gaslamp Business Association under a contract to manage the area’s Business Improvement District. Because these districts utilize public funds, they must adhere to regulations similar to those governing government agencies. In a September 24 letter to Gaslamp Quarter Association Executive Director Michael Trimble, Chief Housing and Community Development Officer Casey Smith detailed three alleged breaches of contract supported by seven pieces of evidence. Among the evidence cited is a bank statement reflecting a June 30 payment of $10,000 originating from Big Outdoor. Meeting minutes from earlier that month indicate the association’s Board of Directors instructed Trimble to finalize a contract with Big Outdoor for the Comic-Con activation. According to the city, accepting this payment violates conflict of interest laws and breaches the municipal code used to fine Elevue Inc.
Disputed Authorities and Official Responses
Michael Trimble has disputed all of the city’s claims, asserting in a September 25 email to Voice of San Diego that he never suggested to advertisers that he possessed the authority to approve the installation. Trimble stated that the association’s agreement explicitly designated Big Outdoor as the party responsible for securing all necessary city and governmental permits. Public records requests show that advertisers presented a different account to city officials in July. Director of Economic Development Christina Bibler wrote in a morning email on July 22 that the contractor pointed back to the Gaslamp Quarter Association, claiming the association asserted authority over the approval. If the allegations are substantiated, Smith indicated the city holds grounds to terminate its contract with the association immediately. Public funds accounted for $181,000 of the association’s $1.05 million budget during the previous fiscal year, with the remainder generated primarily through advertising and events. The city granted Trimble until October 9 to submit a formal response.
