Ashley Malcolm has been sentenced to 18 years in prison for the manslaughter of 86-year-old John Burke during a Hackney burglary spree. The 40-year-old attacker headbutted the retired plumber in the early hours of September 29, 2025, causing a fractured nose and intracranial bleeding that proved fatal.
The Sentencing at the Old Bailey
Judge Simon Mayo KC handed down an 18-year prison sentence with an additional five years on extended licence during a televised hearing at the Old Bailey on Thursday. Court proceedings established that Malcolm embarked on a sustained course of criminal conduct during the night of September 28 and 29, targeting several residential properties in north London. Judge Mayo told the defendant that he entered the home of two elderly and vulnerable occupants over a prolonged period and delivered the fatal blow that ended Mr Burke’s life.
Malcolm previously pleaded guilty to manslaughter alongside multiple other offences. Before attacking Mr Burke in his Fountayne Road home, Malcolm spent an hour and a half inside the property before leaving with a wheeled shopping trolley. He returned at 2.45am to take more items, leaving the elderly couple’s home in disarray.
Mr Burke’s wife, Peggy, who is 91 years old and suffers from dementia, slept through the entire incident. A carer discovered the broken window and injured homeowner later that morning.
Family Describes Mr Burke as Hard-Working Man
Mr Burke’s family filled the courtroom to deliver powerful victim impact statements detailing the devastating human cost of the crime. Sean Burke, who found his father unresponsive on the bedroom floor the day after the assault, described him as a quiet, hard-working man. Grandson Reece Lambert described Mr Burke as originally from Dublin.
“My dad did not deserve to die in such a way, he had earned the right to pass away from natural causes in his own silent way,” Sean Burke told the court. “There was nothing of any value in the house as my parents did not have much but they had each other.”
Grandson Reece Lambert told the court that his grandfather likely sustained the fatal injuries while protecting the woman he loved with everything he had left. Prior to the attack, Mr Burke had been in poor health and managed several conditions, including dementia.
Hospital Staff Fail to Identify Brain Bleeding
Following the attack, paramedics transported Mr Burke to Homerton Hospital, where he underwent medical tests before staff discharged him at 2.35pm. Hospital officials released him after a locum radiologist failed to identify the bleeding on his brain and broken nose. The following morning, his son discovered him unconscious on the bedroom floor, and an ambulance returned him to the hospital, where medical scans confirmed a devastating and irreversible brain injury.
Within hours of burgling the Burke residence, Malcolm targeted a residential care home in Hackney at 6.25am, running toward a support worker while making loud groaning noises. Just minutes later at 6.55am, Malcolm attempted to break into a nearby flat in Stamford Hill using a screwdriver. When the female resident challenged him while wearing a towel, her husband rushed downstairs armed with a bicycle pump, which Malcolm seized and used to attack him.
