CDA Consult Proposes Mandatory Medical Checks for Workers

Ghanaian Labour Act Review Prompts Proposal For Four-Stage Medical Examination System

“If the law requires or allows employers to check the health status of potential employees before employment, then it must equally require employers to check the health status of workers before they exit employment,” Francis Ameyibor stated during discussions on worker protections.

The Communication for Development and Advocacy Consult (CDA Consult) is urging the committee reviewing Ghana’s Labour Act 2003 (Act 651) to overhaul worker health protections by introducing a mandatory four-stage medical examination system. Executive Director Francis Ameyibor argued that current hiring practices force prospective employees through pre-employment screenings while ignoring the long-term physical toll of years of labor.

Proposed Four-Stage Health Assessment Structure

The framework proposed by CDA Consult spans the entire employment cycle, requiring employers to bear the full financial responsibility for all assessments. The system mandates pre-employment screening, continuous annual checkups, a pre-exit evaluation, and a ten-year post-exit medical surveillance period.

Pre-entry examinations are intended to establish a standardized baseline health condition rather than serve as a filter to exclude individuals with manageable medical conditions. These baseline records would be maintained jointly by employers and a National Occupational Health Registry to track potential workplace deterioration over time. Continuous annual assessments would then monitor health shifts throughout the worker’s tenure.

Employers Must Fund Pre-Exit Medical Exams

Under the proposed framework, a compulsory pre-exit medical examination must occur no more than one month before a worker leaves a position, regardless of whether the departure stems from retirement, resignation, termination, or contract expiration. Any work-related health complications identified at this stage would become the responsibility of the employer regarding treatment, compensation, and rehabilitation under the Workmen’s Compensation Act.

CDA Consult also recommends ten years of mandatory medical surveillance following employment exit. Ameyibor noted that serious occupational illnesses—such as cancers linked to chemical exposure, silicosis, kidney diseases, hearing loss, musculoskeletal disorders, and mental health conditions—frequently take years to manifest after exposure has ceased.

Frequently Asked Questions About the Proposed Health Justice Framework

Which industries currently require pre-employment medical examinations in Ghana?

Compulsory pre-employment medical screenings are already common practice across several sectors in Ghana, including mining, manufacturing, banking, security services, and the public and civil services.

What specific post-exit conditions does the CDA Consult proposal target?

The ten-year post-employment surveillance targets long-latency occupational illnesses such as chemical-exposure cancers, respiratory ailments like silicosis, kidney diseases, hearing loss, musculoskeletal disorders, and mental health conditions.

What legal framework would govern employer responsibility for post-exit illnesses?

The proposed framework relies on provisions within the Workmen’s Compensation Act and applicable international labour standards to mandate employer responsibility for medical treatment, compensation, and rehabilitation.
