Dublin Man Sentenced to Three Years in Prison for Partner Assault

A Dublin man, Daniel O’Neill, has been sentenced to three years in prison for assaulting his partner in a brutal attack that occurred in broad daylight in June 2023. The sentencing took place at the Dublin Circuit Criminal Court on Thursday, following O’Neill’s guilty plea.

Details of the Assault

Daniel O’Neill (38), of Cromlech Court, Poppintree in Ballymun, pleaded guilty to assaulting the woman, causing her harm, on June 5th, 2023. Garda Thomas Conneely testified that he responded to a call regarding a domestic incident at the injured party’s home on Sandyhill Gardens shortly after 7:00 PM. Upon arrival, he discovered O’Neill strangling the woman outside her residence.

According to Garda Conneely’s testimony, the woman was on her knees while O’Neill had his hands around her neck. She sustained visible injuries, including blood on her face, and O’Neill displayed what appeared to be defensive wounds on his chest. O’Neill ceased the assault upon Garda Conneely’s intervention but resisted arrest.

Inside the house, Garda Conneely found a scene of disarray with blood covering the floor. The victim suffered a laceration to her forehead, requiring sutures at the hospital. She now bears a scar from the injury.

Toxic Relationship and History of Violence

The court heard that the victim and O’Neill were both in their mid-30s at the time of the incident and involved in a turbulent relationship marked by substance abuse. The victim is currently homeless. She reported to Gardaí that O’Neill had pushed her to the floor and began choking her after she arrived home at 6:30 PM. When she attempted to escape, he attacked her with a shopping bag containing glass bottles, causing the forehead laceration. He then pursued her outside and resumed the assault until Garda Conneely intervened.

Critically, the woman informed Gardaí that O’Neill was on bail for a previous assault against her and was in violation of bail conditions that prohibited contact with her and the address on Sandyhill Gardens.

Following her hospital release, the victim sought refuge in a safe house rather than returning home.

Defendant’s Criminal History and Mitigating Factors

O’Neill has a significant criminal record, with 27 prior convictions including assault causing harm, robbery, burglary, and theft. He had previously received a four-month sentence for assaulting the same woman and is currently serving a four-year sentence with two years suspended for other assault convictions, with a release date in December.

During the sentencing, defense counsel Joe Mulrean presented a letter of apology from O’Neill, expressing deep remorse. Mulrean detailed O’Neill’s challenging upbringing in Ballymun, marked by parental alcoholism and the loss of a sibling at a young age. He had worked with his father in construction until recent years, but his life spiraled into chaos following the start of the relationship with the victim and subsequent addiction to intoxicants.

Mulrean highlighted O’Neill’s homelessness and the recent death of his father after a battle with cancer, attributing his client’s actions to the influence of drugs and a sense of personal failure.

Sentencing and Court Remarks

Judge Orla Crowe acknowledged the “shocking elements” of the case, emphasizing the severity of the assault and the victim’s need for refuge. She sentenced O’Neill to three years in prison, suspending the final three months for two years. A condition of the sentence prohibits any contact between O’Neill and the injured party for two years following his release.

Judge Crowe noted O’Neill’s history of violence, stating, “He’s a person with a violent history.”
