The decision comes after two members of the disciplinary appeals panel stepped down on legal advice, leaving only one remaining member who acknowledged she could no longer participate in the process. Justice Brian Cregan determined that Burke’s challenge to the panel’s membership was moot following the resignations of Department of Education nominee Seán Ó Longáin and Jack Cleary, child protection advisor with the Joint Managerial Body for Voluntary Secondary Schools. The judge ruled that the remaining panel member, Geraldine O’Brien of the Association of Secondary Teachers, Ireland, could not continue due to accusations of objective bias raised by Burke, even though she had not formally resigned. The court ordered that a new disciplinary appeal panel must be convened to hear Burke’s case, marking the third such panel formed to consider his dismissal. Burke was originally dismissed by the school’s board of management in January 2023 following a dispute in June 2022 concerning a student’s gender identity and the utilize of pronouns requested by the principal. He has remained on full pay from the Department of Education pending the appeal outcome, with his salary diverted to pay fines incurred for contempt of court. Burke has been imprisoned multiple times, totaling nearly 600 days, for violating court orders issued in August 2022 that required him to stay away from Wilson’s Hospital School. His legal team had sought an injunction to halt the appeal process, which the High Court initially acknowledged as serious, leading to his temporary release on January 14th to prepare his case. However, he was re-imprisoned days later after returning to school property. During the February 20th hearing, Burke appeared via videolink from prison and criticized the panel as a “shambles.” After interrupting legal submissions, he was escorted from the courtroom by prison guards, describing the removal as “disgraceful.” The judge also directed gardaí to remove Burke’s sister Ammi and mother Martina after they began shouting at him following his exit. The ruling clears the way for a fresh appeal process to begin, with a new panel to be appointed to review the circumstances surrounding Burke’s dismissal. No date has been set for the reconstituted panel’s hearing.
