Fincantieri and Monfalcone Municipality Dispute Over Night Work Postponed in Court

A hearing before the Friuli Venezia Giulia Regional Administrative Court concerning a dispute between Fincantieri and the Municipality of Monfalcone regarding nighttime work at the Monfalcone shipyard has been postponed to a later date. The core of the issue revolves around Fincantieri’s request to work at night to expedite the installation of new cranes.

Background of the Dispute

Fincantieri initially sought permission to conduct work, including the installation of new cranes, during nighttime hours. The company explained to the court that the construction site was completed, and the request for precautionary measures was withdrawn. However, Fincantieri maintained its interest in establishing any administrative irregularities at the court as a prerequisite for potential damage compensation.

Municipality’s Response and Potential Legal Action

The Municipality of Monfalcone has reserved the right to file a complaint for defamation related to certain news reports published in the press. The administration asserts that Fincantieri has not initiated any legal action against the municipality seeking compensation for alleged damages, characterizing such claims as “pure speculation.” Fincantieri confirmed that, as of now, there is no formal request for damages, but the possibility remains open, leading to the continuation of the appeal to the TAR (Regional Administrative Court).

Court Postponement and Municipality’s Stance

The postponement of today’s hearing was underscored by the Municipality as evidence of the appeal’s “instrumentality, unfoundedness and speciousness.”
