Olivier Martinez Files for Custody and Restraining Order Against Halle Berry
Oscar-winning actress Halle Berry faces severe allegations from her ex-husband, Olivier Martinez, who has initiated legal action in Los Angeles County seeking custody of their son, Maceo. Court documents cited by People reveal that Martinez accuses Berry of physical, verbal, and emotional abuse, prompting a Los Angeles judge to issue a temporary restraining order against the actress.
The legal filing details an alleged incident where Berry purportedly choked the boy. According to court papers reported by People, Martinez claims Berry grabbed Maceo around the neck and squeezed while shouting, Who is dominant now?! Who is dominant?
Martinez also asserted in the documents that the child contacted him in a state of panic, begging to be picked up immediately.
Halle Berry Categorically Denies Abuse Allegations and Cites History of Domestic Violence
Berry has strongly rejected the accusations through her legal representation. In statements reproduced by People, the 60-year-old actress declared, I have never physically, emotionally or otherwise abused Maceo. I have myself been a victim of domestic violence, and I help victims of domestic violence.
She added, I am not violent. I would never be able to harm our child.
Berry’s attorney, Marina Beck, dismissed the petition as entirely baseless and deliberately misleading. Berry offered a different version of the disputed confrontation, stating that she entered her son's room to address his video game usage while filming him. According to Berry’s account, a scuffle ensued when he took her phone, which she described as horseplay they frequently engage in, before her fiancé, Van Hunt, intervened.
Los Angeles Court Grants Limited Visitation and Schedules October Hearing
While the Los Angeles County judge granted Martinez a temporary restraining order, the court rejected his request to entirely sever Berry’s contact with her son. Instead, the judge restricted Berry’s visitation to Mondays, Tuesdays, Saturdays, and Sundays between 10:00 a.m. and 8:00 p.m. A follow-up court hearing is officially scheduled for October 16.
The legal dispute follows the finalized dissolution of Berry and Martinez’s marriage in 2023, which concluded after an eight-year separation process that began when they filed for divorce in 2015. In her response, Berry has petitioned the court to reinstate the original 50/50 joint custody arrangement established when their divorce was settled in August 2023.
