Insurance Company Seeks Video Footage of Fatal School Bus Accident in Jamestown

Jamestown, NY – Progressive Casualty Insurance Company is seeking video footage from the Jamestown Public Schools District that may have captured the moments leading up to and following a fatal accident in November 2025. The accident involved a Panama Central School bus and a four-year-old girl, Leanna Herrera, who tragically died after being struck by the bus.

Details of the Incident and Legal Action

On November 17, 2025, Leanna Herrera was hit by a Panama Central School bus while it was making an out-of-district student drop-off near Fletcher Elementary School. According to reports, the bus driver reported being distracted by another vehicle at the time of the accident.

Progressive insured the driver of a vehicle facing south on Whitehill and Cole avenues. While not directly involved in the accident, the driver of this vehicle is named in a damages claim filed by the Herrera family, as they were mentioned in the initial police report. The police report indicated the vehicle was “slowly moving into the intersection as if it was attempting to see and appear for traffic.” The bus driver stated he was observing this vehicle to ensure it didn’t enter the intersection when the young girl ran into the road.

Request for Video Footage

The insurance company filed a pre-action discovery motion in state Supreme Court in Mayville, requesting the Jamestown Public Schools District to turn over any video footage captured by cameras at or near Fletcher Elementary School (located at 301 Cole Ave., Jamestown, NY). Kevin Graff, an attorney from the Law Offices of Jennifer S. Adams, represents Progressive in this matter.

The legal request emphasizes the importance of the video footage to Progressive’s investigation and defense. Graff stated in court documents that the insurance company would be “severely prejudiced if the video was not maintained and produced to them.” He similarly warned that the destruction of the video would “materially harm” their ability to investigate the incident and defend their insured.

Current Status and Further Investigation

As of March 4, 2026, the insurance claim is the only known claim related to the November 2025 accident. A hearing has been requested in state Supreme Court to determine whether the video footage should be preserved and released to the insurance company. Jamestown police and Recent York State Police investigated the scene, which was closed for several hours following the incident.
