The proposed legislation mandates a total amnesty, requiring Philhealth to pay all claims submitted late—whether currently at the refilling, administrative protest, or appeal stage, or previously denied with finality.
Rodriguez stated that while PhilHealth’s enforced 60-day claims filing deadline aims to streamline operations, it has inadvertently caused approximately PHP 20 billion in claims denials between 2018 and 2024. According to the lawmaker, this strict cutoff places severe financial strain on health facilities, particularly in underserved provincial areas, and triggers the partial or total closure of small provincial hospitals.
Supreme Court Precedent and Constitutional Health Mandates
In his explanatory note for House Bill No. 11398, Rodriguez invoked constitutional provisions directing the state to adopt a comprehensive approach to health development and prioritize the needs of the underprivileged, sick, and elderly. The measure references a recent Supreme Court ruling involving PhilHealth and the Chinese General Hospital and Medical Center.
According to that judicial review, the Supreme Court upheld a Court of Appeals decision ordering PhilHealth to pay belatedly filed claims. The high court emphasized that rigid procedural rules should not undermine the core objective of the national health insurance program, which is ensuring financial access to essential health services for all Filipinos.
PhilHealth Utilization and Z Benefits Payouts
