Dutch Manure Crisis Deepens: Anticipated Surplus to Reach 95 Kilotonnes of Nitrogen in 2026

The Netherlands is facing a growing crisis related to manure surplus, largely stemming from changes to European Union regulations. A key exemption to the EU’s Nitrates Directive is being phased out, leading to an anticipated yearly surplus of 95 kilotonnes (210 million pounds) of nitrogen in 2026, according to the Dutch Center for Valorisaton of Manure (NCM). This situation poses significant challenges for Dutch farmers and raises concerns about water quality and environmental sustainability.

Background: The Nitrates Directive and Dutch Exemptions

The European Union enacted the Nitrates Directive in 1991 to combat nutrient pollution of water sources. Excessive nitrate and phosphate levels, primarily from agricultural runoff, contribute to algae blooms, reduced biodiversity, increased methane emissions, and compromised water quality for drinking and recreation. The directive limits the use of organic fertilizer to 170 kilograms of reactive nitrogen per hectare.

However, the Netherlands received an exemption in 2006, allowing farmers, particularly dairy farmers, to exceed these limits. This was due to the fact that grasslands, common in the Dutch agricultural landscape, absorb more nitrogen than cropland. The exemption facilitated more intensive dairy farming practices.

The Phasing Out of the Exemption and the Impending Surplus

The expiration of this exemption between 2023 and 2025 is the primary driver of the anticipated manure crisis. Without the ability to utilize all the manure produced for fertilization, Dutch farmers are projected to face a substantial surplus. The NCM estimates this surplus will reach 95 kilotonnes of nitrogen annually by 2026.

Government Response and “Top Polluters”

The Dutch government is attempting to address the broader nitrogen problem, which contributes to the manure crisis, by identifying and targeting “top polluters” for potential buy-outs. These are companies, including farms, with the most significant impact on vulnerable ecosystems. The process of determining who qualifies as a “top polluter” involves dividing nature reserves into hexagons to assess nitrogen impact.

Legal and Research Efforts

Legal experts, such as Chris Backes, professor of environmental law at Utrecht University, are actively involved in finding solutions to the nitrogen pollution crisis. Research focuses on identifying viable pathways to address the issue, although as well acknowledging the complexities and potential limitations of various approaches.
