Pennsylvania voters have begun casting ballots in the 2026 general election under federal scrutiny, with control of the U.S. House of Representatives hanging in the balance across four key congressional races. The state, long established as a presidential and legislative battleground, is managing this election cycle amidst a series of legal and political clashes with the Trump administration over voter rolls and election administration.
Federal Legal Battles Over Pennsylvania Voter Rolls
The Department of Justice previously sued Pennsylvania to obtain unredacted voter rolls, a demand rejected by Secretary of the Commonwealth Al Schmidt. A federal judge dismissed the lawsuit in June, making Pennsylvania the 10th state to successfully fend off the DOJ on the issue, pushing the federal agency’s record in these specific challenges to 0-25. Despite the court ruling, the Trump administration has maintained public pressure, with President Donald Trump targeting Pennsylvania in a primetime summer address by claiming the presence of 15,000 noncitizens on state rolls. Schmidt publicly questioned the methodology used by the Department of Homeland Security to generate those figures.
Homeland Security Secretary Markwayne Mullin and the DOJ both issued threats to prosecute local election officials personally for any incidents of illegal voting. The Department of Homeland Security subsequently acknowledged it lacked high confidence in its noncitizen claims. Meanwhile, a voter roll audit conducted in April by state Auditor General Timothy DeFoor examined more than 200,000 motor-voter registrations processed by PennDOT during the first half of 2024. That audit identified just one registered noncitizen, an individual who never voted and whose registration was promptly canceled.
Funding Disputes and Security Grants
The friction between federal authorities and the Commonwealth extended to federal security funding over the summer, when the Department of Homeland Security began withholding security grants from states, including Pennsylvania, that declined to meet federal election demands. In response, Governor Josh Shapiro joined a coalition of states in filing a lawsuit against the agency over what plaintiffs described as an extortion scheme. Concurrent federal actions included a voter fraud investigation surge launched by Homeland Security Investigations in targeted states like Pennsylvania, according to an August report by CNN, followed by the DOJ’s announcement in September of fraudulent registration charges against three individuals in the state.
Despite these federal pressures, state election officials report that voting operations are proceeding as planned. Schmidt noted that nearly 1 million mail ballot applications have already been approved for the current election cycle. Pennsylvania does not feature traditional early voting; instead, eligible voters may cast mail ballots in person at designated county election offices. Data from the University of Florida’s Election Lab early vote tracker shows nearly 14,000 mail ballots returned in Pennsylvania. Counties can utilize a new “On Demand Mail Ballot Voting” toolkit introduced by Schmidt to streamline the voting process. Voters may drop off mail ballots in person until 8 p.m. on Election Day, and the deadline to request a mail ballot is October 27. Schmidt has also hosted weekly press briefings this fall to counter potential misinformation.
