Pinterest Faces Setback in Patent Dispute with Kudelski Subsidiary
Pinterest Inc. has been unsuccessful in its attempt to invalidate three patents held by OpenTV Inc., a U.S. subsidiary of Switzerland-based Kudelski SA, in a case before the US District Court for the District of Delaware. The patents relate to targeted advertising and smart playlist curation technologies.
The court determined that OpenTV plausibly demonstrated an inventive concept within its targeted advertising patent, moving beyond the realm of abstract ideas. Moreover, Judge Jennifer Choe-Groves ruled that a valid dispute exists regarding the interpretation of claims in the two smart playlist patents, specifically concerning the definition of “social connections,” and that further litigation is warranted to clarify these claims before a validity determination can be made.
