Rental Tax Reductions Now 15% to 100%, elconfidencial.com reports

Two housing decrees approved by the Council of Ministers on October 6, 2026, overhaul rental tax deductions in Spain into a sliding scale ranging from 15% to 100%, elconfidencial.com reported. Rather than a flat reduction, the net rental yield is now taxed based on contract terms, rental pricing, and property location, taking effect for agreements signed from December 1, 2026.

The New Sliding Scale for Rental Income Tax Reductions

When landlords rent out a property, Spain’s tax agency calculates tax on the net yield—the income remaining after deducting property taxes, community fees, insurance, and repairs. Under the revised framework, reductions on this net yield fluctuate widely depending on contractual decisions made on day one. A landlord lowering rent by more than 5% on a new contract can secure deductions between 70% and 100%. Conversely, raising the rent triggers penalties: a rent hike exceeding 20% slashes the tax reduction down to just 15%.

Luis Miguel Larriba, a tax lawyer at LRB Tax & Legal, notes that most property owners remain unaware that their tax percentage depends on choices made at the signing table rather than at tax filing time. For a property generating 8,000 euros in net yield, the tax burden can swing from zero to over 2,000 euros purely based on the structure of the lease.

Timeline of Effective Dates and Transition Rules

The transition to the new tax system depends heavily on when contracts were executed:

  • Contracts before the 2023 Housing Law: Maintain the reductions in place at the end of 2021.
  • Contracts signed between 2023 and November 30, 2026: Retain the rules active at the close of 2025.
  • Contracts signed from December 1, 2026: Subject to the new 15% to 100% sliding scale.
  • Tacit extensions: An 80% reduction applies regardless of contract date, provided the initial five-year minimum term expires after December 1, 2026, the starting rent did not exceed official index limits, and the owner is not a large-scale holder.

Restrictions on Large-Scale Property Holders

Access to these tax reductions excludes property owners classified as large-scale holders at the time of signing. Generally, a large holder owns more than 10 urban residential properties or over 1,500 square meters of residential floor space, excluding garages and storage rooms.

New Regulations on Contract Renewals and Tenant Compensation

A second decree, Decree 28/2026, took effect on November 15, 2026, altering contract renewals. When an initial five-year or seven-year lease reaches its term, it automatically extends for another five or seven years unless proper notice is given.

Lawmakers must validate decrees to avoid repeal

If lawmakers fail to validate them, the decrees will face repeal, mirroring the fate of previous decrees from September 29.

Who qualifies for maximum tax reductions?

Who qualifies for the maximum 100% tax reduction?

The 100% reduction applies to landlords who renew a lease with the same tenant after the minimum term ends, sign with a new tenant at a rent below official price index limits, or lease a property for the first time below those limits.

How are temporary rental contracts affected?

Temporary leases require a real, demonstrable cause and cannot exceed 12 months without justification. Back-to-back temporary contracts involving the same parties and property automatically convert the arrangement into a standard habitual lease from day one.

What are the new rules for property renovation VAT?

Starting December 1, 2026, renovation and repair works on residential rental properties qualify for a reduced 10% VAT rate instead of the general 21% rate, provided payments are made via traceable electronic banking methods.

What happens if a landlord fails to declare rental income correctly?

Tax reductions apply strictly to amounts declared voluntarily before an inspection begins. Any income regularized by the tax agency during an audit loses eligibility for the reduction entirely.
