  Pass the building green development regulations with a focus on key issues

“Accelerating legislation in key areas” is an important content of the work points for the whole year of 2023 established by the Standing Committee of the 16th Municipal People’s Congress.

The formulation of important local regulations such as the Regulations on the Construction of the International Science and Technology Innovation Center, the Regulations on the Promotion of Rural Revitalization, the Regulations on the Green Development of Buildings, and the Regulations on Foreign Investment are all legislative projects focused on key areas of the capital’s economic and social development.

Over the past year, the Municipal People’s Congress Standing Committee has reviewed many local regulations, including the Beijing Regulations on the Protection of Minors (Revised), the Beijing Measures for the Implementation of the Anti-Terrorism Law of the People’s Republic of China, and the Beijing Regulations on the Green Development of Buildings. For example, the Beijing Municipal Building Green Development Regulations are legislative projects in key areas that will be reviewed and voted on three times by the Standing Committee of the National People’s Congress in 2023.

The construction industry is a key area for Beijing to achieve carbon neutrality. By the end of the “13th Five-Year Plan”, the energy consumption of civil buildings in China has accounted for more than 50% of the total energy consumption of the whole society, and the total building energy consumption will continue to rise with the growth of building area. Be problem-oriented and find the right openings to “solve problems” in legislation.

During the legislative process of Beijing’s Green Building Development Regulations, the Urban Construction and Environmental Protection Office of the Standing Committee of the Municipal People’s Congress, together with the Municipal Housing and Urban-Rural Development Committee, systematically sorted out the issues reflected in the preliminary legislative research and formed a list of 54 issues covering 13 aspects. Six research topics were identified: “development and construction”, “planning and design”, “construction and operation”, “industrial development orientation”, “prefabricated buildings” and “urban sub-center”.

In the legislative process of the regulations, opinions are widely solicited through various methods to gather public opinions and incorporate people’s wisdom to the greatest extent. During the drafting and deliberation stage, representatives of the Municipal People’s Congress formed six special groups in relevant fields to conduct simultaneous research and form a special research report; through the members of the Municipal People’s Congress Standing Committee Directors’ Meeting, they contacted the working mechanism of the District People’s Congress Standing Committee to solicit opinions; and used grassroots legislative contact points , rule of law construction consultant and other working systems, soliciting opinions from grassroots units, market entities, urban planning societies, lawyers associations, and experts and scholars in the field of law and industry.

Before the third review, the Municipal People’s Congress Legal Committee, together with some members of the Standing Committee, went to the “three major buildings” in the city’s sub-center, the prefabricated housing construction project, and the Lize Financial Business District to discuss the construction, operation, and maintenance of green buildings and prefabricated buildings. Carry out on-the-spot investigations on issues such as construction and other issues, and listen to opinions and suggestions from relevant entities participating in the construction, property service companies, grassroots legislative contact points and other units.

The Legislative Affairs Committee also solicited written opinions from relevant departments of the State Council, the legal construction consultant of the Municipal People’s Congress Standing Committee and 12 grassroots legislative contact points on the second review draft of the draft. Combining the opinions of all parties, the Municipal People’s Congress Legal Committee held a meeting to conduct unified deliberation, and made modifications in aspects such as public participation and child-friendly transformation, and optimized and integrated some parts of the regulations.

The Building Green Development Regulations were reviewed three times and passed on November 24 last year.   Revise regulations on the protection of minors in response to social concerns

Looking back at the legislative work of the Beijing Municipal People’s Congress Standing Committee in 2023, there are not only legislative projects focusing on important areas of capital development, such as the above-mentioned building green development regulations, but also the completion of important legislative work that responds to people’s livelihood concerns.

The first local regulation passed by the Standing Committee of the 16th Municipal People’s Congress is such an example.

On May 26, 2023, the third meeting of the Standing Committee of the 16th Municipal People’s Congress voted to adopt the Regulations on the Protection of Minors. On November 24, 2022, the 45th meeting of the Standing Committee of the 15th Municipal People’s Congress conducted its first review of the “Beijing Regulations on the Protection of Minors (Revised Draft)” submitted by the municipal government. After in-depth investigation and careful study, the Social Construction Committee of the Municipal People’s Congress proposed the second review draft of the revised draft at the second meeting of the Standing Committee of the 16th Municipal People’s Congress on March 23, 2023. In accordance with the requirements of the legislative consultation working mechanism, the Legal Affairs Committee of the Municipal People’s Congress Standing Committee conducted consultation and research with the Municipal People’s Congress Social Construction Committee, the Municipal Justice Bureau, and the Municipal Civil Affairs Bureau. On the basis of extensive solicitation of opinions, full communication and research, and comprehensive analysis and judgment, the ideas for the revision work were further clarified, and the second review draft of the revised draft was revised and improved.

Improving the legislative work mechanism is an important requirement for legislative work put forward by the Standing Committee of the 16th National People’s Congress when establishing the key points of work for the whole year of 2023.

How to improve the mechanism? The Standing Committee of the Municipal People’s Congress follows the legislative work pattern of “party committee leadership, National People’s Congress dominance, government support, and participation of all parties”, improves the research and drafting mechanism of “early intervention, special class promotion, and ‘double leader system'” and improves the “four fronts and four parties” consultation mechanism, actively carry out legislative consultations, and strengthen and improve legislative research. Adhering to the press conference system after the passage of regulations is an important part of the legislative working mechanism.
