A panel based in San Francisco declined requests by the platforms to overturn lower court rulings, leaving tech giants including Meta, Google, TikTok, and Snapchat facing mounting legal liability over child safety and platform addiction.
Meta and TikTok argued they were fully protected by Section 230 of the 1996 Communications Decency Act, a federal statute that shields internet platforms from liability for user-generated content. According to the court’s interpretation, Section 230 establishes a liability shield rather than a blanket immunity from litigation. Because the statute does not entirely bar lawsuits at the outset, the appeals court concluded that the companies’ appeals were premature.
State Attorneys General Lawsuits and Trial Timelines
In the same ruling, the Ninth Circuit denied a request from Meta to stay proceedings related to a separate lawsuit filed by 29 state attorneys general. That lawsuit accuses Meta of unlawfully collecting children’s data, engineering features to maximize user engagement time, and misleading the public regarding platform safety. The trial for the state attorneys general litigation is scheduled to begin on August 12 in Oakland, California, according to court schedules.
The broader wave of litigation involves lawsuits brought by state and local governments, school districts, and private individuals. Plaintiffs argue that features designed to attract and retain young users contribute directly to rising rates of depression, anxiety, and other adolescent mental health crises. Over 3,000 federal lawsuits are currently pending before US District Judge Yvonne Gonzalez Rogers in Oakland, California, alongside approximately 3,300 coordinated similar cases consolidated in California state court.
