Federal Court Intervenes Over White House Press Access

Judge Timothy Kelly granted a temporary restraining order requiring the administration to return the credentials. The legal challenge began after President Donald Trump announced the ban on three outlets, claiming their reporting constituted fake news. CNN, MS NOW, and Politico filed a joint lawsuit arguing the action violated the First Amendment.

Judge Kelly concluded that revoking the press passes “domājams, pārkāpa viņu konstitucionālās tiesības uz tiesisku procesu”. According to the judge’s opinion, established legal principles dictate that individuals must receive notice and an opportunity to be heard before the government strips them of constitutionally protected interests. The temporary order is active for 14 days to preserve the status quo while the litigation proceeds.

Contrasting Arguments Over National Security and Free Speech

The legal battle highlighted a sharp disagreement between administration justifications and press freedom arguments. President Trump stated on Truth Social that the ban targeted outlets spreading false narratives, writing that they are a “drauds mūsu nacionālajai drošībai”. Vice President J.D. Vance similarly characterized the journalism produced by the three outlets as “far-left propaganda.”

However, during court proceedings, Judge Kelly noted a shift in the administration’s legal stance. The judge pointed out that while the initial public justification centered on false reporting claims, subsequent administration arguments asserted that specific coverage—such as reporting on the construction of an annex to the White House event room—endangered national security. Judge Kelly found those national security rationales unpersuasive in justifying the immediate revocation of press credentials.

Journalism Pools and Industry Solidarity

The enforcement of the ban immediately disrupted standard White House press operations. Alongside losing individual hard passes, CNN was excluded from the five-network television pool rotation, which records and distributes presidential activity footage to other news organizations.

In response to the exclusion, major broadcast networks—including ABC, CBS, NBC, and Fox News—announced that the pool services would not be provided. The collective pushback by the broader press corps preceded the joint federal lawsuit filed by CNN, MS NOW, and Politico.
