Grove was found guilty on counts five through seven, as well as counts 19 and 20, relating to child endangerment, but was acquitted on rape charges and several other counts after the judge determined the state failed to prove those specific allegations beyond a reasonable doubt.

Judge Robert Peeler acquitted Grove on counts one through four, which involved rape charges, alongside counts six, eight, and nine for gross sexual imposition, and count 18 for corrupting another with drugs. The defense successfully argued that text messages central to the prosecution’s case represented fantasy and roleplay between Grove and her then-partner, Tony McCollister. Addressing those communications, Judge Peeler stated that while the messages were repulsive and ignited a visceral urge to condemn the defendant for perverse conversations, a civilized society does not punish individuals for thoughts alone.
Counts 10 through 17 had been dismissed prior to the start of the trial. Under Marci’s Law, sentencing cannot proceed immediately and will be scheduled for a later date. Judge Peeler noted that a pre-sentence investigation is unnecessary because he has heard and seen enough evidence during the proceedings.
Upcoming Court Dates and Related Cases
Grove is scheduled for a pre-sentence interview on Thursday regarding previous charges involving sexual conduct with dogs, to which she previously pleaded guilty. Outside the courtroom, neighbors and family members who wore pink in support of the young victim expressed relief over the verdict. Meanwhile, Grove’s former partner, Tony McCollister, is scheduled to begin his own bench trial before Judge Peeler on Monday.
