Modification of Duties on Imports from Brazil

By the authority given to me as President by the Constitution and the laws of the United States of America, including the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.) (IEEPA), the National Emergencies Act (50 U.S.C. 1601 et seq.),section 604 of the Trade act of 1974,as amended (19 U.S.C. 2483), and section 301 of title 3, United States Code, I order:

Section 1. Background. In Executive Order 14323 of July 30, 2025 (Addressing Threats to the United States by the Goverment of Brazil), I stated that the policies, practices, and actions of the Brazilian government were a serious threat to the national security, foreign policy, and economy of the United States. This threat comes from outside the United States. I declared a national emergency because of this threat and decided to add a 40 percent duty to certain goods from Brazil.I also listed some goods in Annex I to Executive Order 14323 that woudl not have this extra duty.

On October 6, 2025, I spoke with Brazilian President Luiz Inácio Lula da Silva. We agreed to start talks to address the issues raised in Executive Order 14323. Thes talks are still happening. I have also received advice from officials who are watching the situation related to the emergency declared in Executive Order 14323.They believe some agricultural imports from Brazil should no longer have the extra 40 percent duty as we have made some initial progress in talks with the Brazilian government.

After considering this facts and the status of talks with the brazilian government, I have decided to change which products are subject to the extra 40 percent duty under Executive Order 14323. Specifically, I have decided that certain agricultural products will not be subject to this duty.
