Vietnam’s National Assembly is reviewing a modified draft law on legal dissemination and education that proposes mandatory communal-level coordination councils led by local commune-level People’s Committee chairpersons, according to proceedings from the legislative session. The proposed framework aims to streamline legal outreach at the grassroots level where administrative interaction with citizens is highest.
Grassroots Legal Needs and Current Implementation Gaps
According to the Ministry of Justice, over 1,300 local jurisdictions across Vietnam have already established and maintained coordination councils for legal education, despite no existing legal mandate requiring them. Lawmakers debating the draft law on August 9 argued that legalizing this model is necessary to address heavy workloads for local judicial officials. National Assembly deputy Phan Thi My Dung, representing Tay Ninh province, noted that each commune or ward People’s Committee typically assigns only one or two officials to manage judicial affairs. These responsibilities range from drafting legal documents and reviewing local regulations to civil status certification, notarization, local mediation, and public legal education.
Without an institutionalized coordination mechanism, individual officials face severe burdens when trying to advise local authorities and educate the public. Delegate Phan Thi My Dung emphasized that local authorities directly handle administrative procedures and state management tasks, generating constant public demand for legal guidance and explanation.
Structure and Multisectoral Responsibilities of Communal Councils
Under the proposed structure, the council president will be the chairperson of the communal People’s Committee. Membership will draw from local entities directly interacting with the population, including police units, military personnel, judicial authorities, and local Fatherland Front committees. National Assembly deputy Hoang Thi Thu Trang, representing Nghe An province, stressed that because the councils will operate without dedicated personnel or separate budgets, success relies on active mobilization across the entire political system. Clear operational rules are required to divide responsibilities harmoniously among participating agencies.
Adding to these operational considerations, National Assembly deputy Do Duc Hong Ha from the Hanoi delegation suggested that communal judicial officers must shift toward increased digital transformation and reduced administrative tasks. This shift will allow officials to focus squarely on public legal education. Furthermore, delegate Pham Thi Minh Hue of the Can Tho delegation supported making the councils mandatory, pointing out that public legal dissemination is a multisectoral duty requiring active coordination between government bodies, sociopolitical organizations, and specialized agencies.
Future Implementation and Legislative Outlook
Lawmakers recommended that the central government issue detailed regulations defining the exact duties, powers, composition, and activities of these communal coordination councils to match established frameworks at central and provincial levels. The National Assembly continues its review of the modified draft law to finalize implementation guidelines for local authorities nationwide.
