Jerry Sandusky Accuser to Recant Testimony, Judge Sets Evidentiary Hearing

Convicted child molester and former Penn State assistant football coach Jerry Sandusky is scheduled to appear in a Centre County courtroom on Sept. 8 for an evidentiary hearing, according to court documents cited by The Associated Press. The hearing follows a post-conviction relief petition filed by Sandusky’s legal team, which centers on a recantation from one of the primary accusers who testified during his 2012 trial.

The Recantation of Victim 10

The upcoming court date was granted after an accuser known in court records as Victim 10, and identified in filings as R.R., submitted a sworn affidavit stating that Sandusky did not abuse him, according to ABC News. In the affidavit, the accuser alleges that prosecutors and investigators coached him during the pretrial process to steer his testimony. R.R. claims he was told that trauma may have caused a fragmented memory, leading him to affirm details he could not fully recall. Sandusky, now 82, is currently serving a 30- to 60-year prison sentence at the Laurel Highlands State Correctional Institution after a Pennsylvania jury convicted him on 45 counts of child sex abuse in June 2012.

Legal Arguments and Prosecution Response

Sandusky’s defense team argues in their amended petition that authorities used suggestive interviewing techniques and therapy to influence witnesses, according to Fox News. The defense also included an affidavit from R.R.’s estranged wife, Jasmine Rittmeyer, who stated she could testify regarding the allegations. Attorneys from the Pennsylvania Attorney General’s Office filed a motion opposing Rittmeyer’s testimony, describing her prospective statements as irrelevant and inadmissible opinion regarding events from over a decade ago. Prosecutors also maintain that the evidentiary hearing should focus narrowly on the accuser’s recantation rather than reopening the broader trial record.

Historical Context of the Case

Sandusky was arrested in 2011 following an investigation into his Second Mile charity, an organization he founded for at-risk youth. The ensuing scandal led to the firing of Hall of Fame head coach Joe Paterno and substantial financial settlements by Penn State University, which has paid more than $100 million to individuals asserting abuse, according to The Guardian. Previous appeals and petitions filed by Sandusky over the past decade have been repeatedly denied by the courts, leaving this September evidentiary hearing as his latest legal challenge.
