Vivanta Insolvency and Creditor Deadlines

The corporate structure of the dental chain comprises two distinct entities: Vivanta Dental, S.L.U. and Clínica Vivanta, S.L.U., as reported by the Consumer Service of the Government of Navarra. Clínica Vivanta, S.L.U. was formally declared in insolvency proceedings (concurso de acreedores) on September 15, following an initial court auto issued on September 3, according to consumer association Facua. Under this legal framework, affected users have exactly one month from the official publication date in the Boletín Oficial del Estado to communicate their credits to the insolvency administrator. Consumers must submit their claims before October 15, 2026, accompanied by supporting documentation such as contracts, estimates, invoices, and payment receipts.

Reclaiming Money for Unfinanced and Financed Treatments

For the second corporate entity, Vivanta Dental, S.L.U., insolvency proceedings have not been initiated. According to the Government of Navarra’s Consumer Service, patients who paid for treatments without financing should first submit a formal written claim directly to the company, requesting either the completion of the procedure or the termination of the contract with a full refund for unrendered services. If the company fails to provide a satisfactory response, consumers can escalate the matter to the regional consumer office for administrative mediation or proceed to the courts. Legal representation by a lawyer or solicitor is not mandatory for claims under 2,000 euros.

Patients who used credit tied to specific dental service contracts face a different protocol. Consumer authorities advise notifying both the clinic and the financial institution in writing. Borrowers should request the immediate suspension of future loan collections and the refund of installments already paid for services that will not be delivered. If the financial institution rejects the request or fails to respond, consumers can turn to the Bank of Spain’s Claims Service for resolution.

Essential Documentation and Consumer Rights

Consumer associations emphasize that obtaining the patient dental medical history is a critical first step. This document details which procedures were completed and which remain pending, serving as vital proof for insolvency administrators or financial entities. Clients must preserve all paperwork, including original contracts, service estimates, invoices, and bank transaction receipts, to safeguard their rights throughout the claims process.
