Under the city’s General Municipal Ordinance, officials have the authority to refuse permits if a business significantly impairs the quality of life for surrounding residents.
Plaintiffs claim the physical premises of the Fabel Friet shop are too small to accommodate its high volume of customers. This discrepancy leads to crowds eating on the street, overflowing public trash bins, and increased litter in the immediate vicinity. Residents argue that the current permit lacks sufficiently strict regulations to mitigate these specific disturbances.

Fabel Friet Defends Crowd Management Efforts
Fabel Friet owner Floris Feilzer maintains that the business already takes extensive measures to minimize neighborhood disruption. The shop employs crowd managers to organize the queue and monitor customer behavior after purchase.
Feilzer stated that it is critical that customers do not inconvenience others, noting that one specific crowd manager is dedicated entirely to ensuring people do not eat in front of residential homes or sit on doorsteps.
Previous Legal Rulings on Queue Restrictions
The current court case follows a previous dispute in 2024 regarding the feasibility of city-imposed restrictions. At that time, the municipality demanded that Fabel Friet limit its queue to a maximum of ten people and close one checkout counter during peak periods of congestion.
The court ruled in favor of Fabel Friet in that instance, agreeing with the business that those specific operational requirements were not executable.
