Tánaiste Simon Harris has confirmed that applying a 9% VAT rate to home heating oil is not legally possible under European Union law, despite mounting cost-of-living pressures for households. Responding to written parliamentary questions in the Dáil, the Fine Gael Minister stated that Irish VAT law is strictly bound by EU directives that prohibit lower rates on specific fuel types.
The exchanges in the Dáil involved queries from Independent Ireland TD Ken O’Flynn and Labour TD Ged Nash. Both politicians pressed the government on cutting the current 13.5% VAT rate on kerosene down to 9%, matching the temporary reduced rate currently applied to domestic gas and electricity.
EU VAT Directive Restrictions on Home Heating Oil
Addressing the Dáil, Simon Harris explained that the EU VAT Directive mandates standard VAT rates for all goods and services unless an exemption applies or the item sits within Annex III of the directive, which permits lower rates under strict conditions. Home heating oil is absent from the list of products eligible for these reduced brackets.

While Ireland maintains a long-standing reduced rate of 13.5% on hydrocarbon oils used for domestic and industrial heating fuel, EU rules prevent member states from expanding or altering these historical derogations. “It is not possible to apply a 9% VAT rate to home heating oil under the VAT Directive,” Harris stated in his written response.
The Minister did not provide estimated full-year cost figures for reducing the kerosene levy to 9%, which were requested by both Ken O’Flynn and Ged Nash for fiscal projections extending into 2027.

International Volatility and Upcoming Budget Relief
Households relying on heating oil have absorbed steep price hikes throughout the year. These cost increases stem directly from international market volatility, which has been exacerbated by conflict involving Iran and ongoing shipping disruptions through the Strait of Hormuz.
Earlier this year, Simon Harris characterized the wider global energy squeeze as the worst the world has ever seen. With home heating oil locked out of lower VAT thresholds due to Brussels directives, coalition leaders have indicated that alternative targeted financial supports for utility customers will form part of the upcoming national Budget announcement next month.
