Neighbors of an animal lover from Nizhny Tagil, who settled 8 dogs and 12 cats in his apartment, were unable to force him through the court to get rid of his pets.
As reported in the press service of the courts of the Sverdlovsk region, residents contacted the prosecutor’s office, complaining about constant dog barking at night and a specific smell in the entrance. The prosecutor, on their behalf, went to court, demanding that the animals be resettled in shelters. Since in the Sverdlovsk region the maximum number of lice and dogs for keeping in an apartment has not been established, the prosecutor referred to the provisions of the model law “On the Treatment of Animals” of the Interparliamentary Assembly of the CIS Member States. According to this document, no more than two dogs and one cat, or three cats, or one dog and two cats are allowed in an apartment in a multi-apartment residential building.
The owner of the animals noted in court that all his pets are mongrels who, by the will of fate, ended up on the street. He cannot give them to a shelter, since there are no such shelters. I agree to give some of the animals to good people, but I haven’t found any yet.
The court found that the defendant’s dogs lived in the hallway and hallway, and the cats lived in the kitchen. He walks the dogs on leashes, the cats have litter trays in the kitchen, everyone has their own food bowls. Cats and dogs are sterilized and vaccinated against rabies. The animals are well-fed, well-groomed, look healthy, cheerful, and there are no signs of abuse. The defendant takes care of the pets and, if necessary, provides them with timely veterinary care.
Specialists from Rospotrebnadzor and the veterinary service who went to the disputed apartment, although they noted a specific smell on the site, did not find any gross violations of sanitary rules in the apartment itself and the entrance.
The court noted that the mere number of cats and dogs does not indicate a violation of sanitary norms and rules. The neighbors did not provide evidence of systematic violation of silence at night.
As a result, the Dzerzhinsky District Court of Nizhny Tagil left the prosecutor’s claims unsatisfied. The prosecutor filed an appeal, but the Sverdlovsk Regional Court, having examined the case materials, found no grounds for interfering with the judicial act and left it unchanged.
