Busan Port Authority Official Sentenced to Probation in Embezzlement Case
A man in his 30s, formerly employed by the Busan Port Authority (BPA) labor union, has received a two-year prison sentence suspended for three years on charges of embezzling over 787 million won. The ruling was announced on March 22, 2026, by the 5th Criminal Division of the Busan District Court, presided over by Chief Judge Kim Hyun-soon.
Details of the Embezzlement
The individual, identified only as Mr. A, was indicted on charges of embezzlement and violating the Act on Aggravated Punishment of Specific Economic Crimes. Between June 2020 and December 2023, while working as a member of the BPA labor union, he allegedly embezzled 787.4 million won from a Suhyup account held in the union’s name, transferring the funds to his personal account on 211 separate occasions.
According to court documents, Mr. A was instructed by the union chairman to find a way to earn a higher interest rate on the union dues management account while guaranteeing the principal. He then misappropriated the funds for personal use, including gambling, living expenses and loan repayment.
Investigation and Legal Challenges
The investigation into Mr. A’s activities stemmed from a broader probe into corruption related to the redevelopment of Busan’s North Port. During the trial, Mr. A’s legal team argued that evidence was collected illegally, claiming that search and seizure warrants used to obtain evidence were initially issued for other defendants involved in the North Port redevelopment case. They asserted that a separate warrant should have been obtained for Mr. A specifically.
The defense also contested the amount of the alleged embezzlement, arguing that the prosecution only recognized withdrawal records and failed to account for deposits made into the union account.
Court Ruling
The court rejected the defense’s claims, stating that evidence legally obtained through a valid search and seizure warrant can be used in separate criminal proceedings unless restricted by laws like the Communications Secrets Protection Act. The court also referenced precedent stating that illegally profiting from another’s property, even if later returned, can be acknowledged as a crime.
While acknowledging the seriousness of the offenses considering the duration of the criminal activity, the number of offenses, and the total amount involved, the court suspended the prison sentence, citing Mr. A’s acknowledgement of the facts, the complexity of tracking the funds due to repeated deposits and withdrawals, and the full repayment of the embezzled amount.
North Port Redevelopment Investigation
The embezzlement case is connected to a larger investigation into alleged corruption surrounding the North Port Redevelopment Project, a long-term initiative to revitalize the old North Port pier into a leisure and waterfront space. The investigation has led to the indictment of 15 individuals, including BPA employees, brokers, and construction company representatives, accused of leaking internal information and accepting bribes.
