Visa Restrictions Targeting Foreign Censorship

The newly instituted visa restriction policy applies directly to foreign nationals who engage in flagrant censorship actions against U.S. tech companies, citizens, and residents. According to the United States, it is unacceptable for foreign governments to demand that American tech platforms adopt global content moderation policies that extend beyond their local legal authority.

According to the United States, the South African government has failed to adequately address concerns regarding race-based discriminatory legislation, threats of uncompensated land expropriation, and the incitement of racial violence through dehumanizing chants and slogans. Consequently, the new visa restrictions target foreign nationals responsible for enacting or implementing laws that enable uncompensated land seizures, race-based discrimination, or imminent violence against minority groups in South Africa.

Immigration and Nationality Act Enforcement

Both policy announcements rely on the enforcement mechanisms outlined in Section 212(a)(3)(C) of the Immigration and Nationality Act. The United States maintains that these actions are necessary to protect American sovereignty, uphold the rule of law, and counter behaviors that undermine global economic stability and peace.

The agency urges the South African government to swiftly address the reported discriminatory practices, while simultaneously signaling that foreign encroachments on American free speech will face direct diplomatic and immigration consequences.
