CLARITY Act Faces Diminishing Chances of Passage in 2026

Washington D.C. – The US CLARITY Act, designed to provide a comprehensive regulatory framework for digital assets, is facing increasingly slim odds of being passed into law this year. Experts warn that the window for action is rapidly closing, with a critical deadline approaching at the conclude of April.

What is the CLARITY Act?

Formally known as the Digital Asset Market Clarity Act of 2025, the CLARITY Act aims to end the regulatory uncertainty that has plagued the cryptocurrency industry. Currently, the US regulates crypto largely through enforcement actions by the Securities and Exchange Commission (SEC), often determining on a case-by-case basis whether a digital asset qualifies as a security under decades-vintage laws. The CLARITY Act seeks to establish clear rules of the road, defining which assets are securities, commodities, or something else entirely, and clarifying which regulators have oversight FinTech Weekly.

The bill passed the House of Representatives on July 17, 2025, with a vote of 294-134 Congress.gov, but has stalled in the Senate.

Deadline Looms: April as a Critical Month

According to Alex Thorn, head of firmwide research at Galaxy Digital, if the CLARITY Act doesn’t advance through committee by the end of April, its chances of passage in 2026 become “extremely low.” He further emphasized the need for the bill to reach the Senate floor by early May, noting that time is running out The Block.

US Senate Majority Leader John Thune has indicated that the Senate will prioritize the SAVE America Act, which focuses on voter citizenship verification, before considering the digital asset market structure legislation The Block.

Stablecoin Rewards and Potential Hurdles

The primary point of contention currently appears to be the debate surrounding stablecoin rewards and their potential impact on the traditional banking system. This issue has created a divide within both the banking and crypto industries. However, Thorn cautions that even resolving the stablecoin debate may not guarantee passage, suggesting other issues related to decentralized finance (DeFi), developer protections, and regulatory authority could emerge TradingView.

Senator Angela Alsobrooks, a key Democrat on the Senate Banking Committee, recently acknowledged that compromises will be necessary from both the crypto and banking lobbies, stating that “all of us will probably walk away just a little bit unhappy” TradingView.

Longer-Term Outlook

Some analysts are pessimistic about the CLARITY Act’s prospects in the near term. One investment bank has suggested the bill may not pass until 2029 TradingView. While some lawmakers, like Senator Bernie Moreno, had expressed optimism about a potential April timeline, the current political landscape suggests a more challenging path forward.
