EU Launches Formal Investigation into X Over AI-Generated Sexual Content
The European Union has launched a formal investigation into X (formerly Twitter) over concerns regarding the platformS handling of sexually explicit images generated by its artificial intelligence chatbot, Grok. The investigation, announced on January 26, 2024, centers on potential violations of the Digital Services Act (DSA) [https://digital-services-act.ec.europa.eu/].
The EU Commission is specifically examining whether X is adequately protecting users, particularly children, from illegal and harmful content, and whether its systems for reporting and addressing such content are sufficient. The investigation will focus on X’s content moderation policies, the effectiveness of its notice-and-action mechanisms, and its transparency regarding the use of AI-generated content.
“[We] are concerned that X may be failing to comply with the DSA in several areas,” stated a press release from the European Commission [https://ec.europa.eu/commission/presscorner/detail/en/ip_24_483]. “Specifically, the Commission is concerned about the spread of illegal content, including sexually explicit images generated by AI, on the platform.”
The investigation was triggered by reports highlighting Grok’s ability to generate realistic, sexually explicit images in response to user prompts. Several news outlets, including the BBC [https://www.bbc.com/news/technology-67844499] and CNBC [https://www.cnbc.com/2024/01/26/eu-probes-elon-musks-x-over-sexually-explicit-images-on-grok.html], reported on the issue, raising concerns about the potential for exploitation and the spread of non-consensual imagery. The Guardian [https://www.theguardian.com/technology/2024/jan/26/eu-launches-inquiry-into-x-over-sexually-explicit-images-made-by-grok-ai] also covered the story, emphasizing the DSA implications.
Politico [https://www.politico.com/news/2024/01/26/elon-musk-x-eu-grok-ai-00134484] noted the broader context of the investigation, linking it to concerns about X’s overall content moderation practices under Elon Musk’s ownership.
If found in violation of the DSA, X could face fines of up to 6% of its global annual revenue, or even a ban on operating within the EU. The EU Commission has not set a deadline for the completion of the investigation.
