EU and UK Forge Recent Competition Cooperation Agreement Post-Brexit
Brussels and London have signed an agreement to collaborate on competition investigations and evaluations of corporate operations, marking a significant step in building a new relationship following the United Kingdom’s departure from the European Union. The agreement, finalized on Wednesday, mirrors similar pacts the EU has with the United States [1], Canada, Japan, South Korea, and Switzerland, signaling a move towards closer ties with select global partners.
Key Provisions of the Agreement
The pact will facilitate the exchange of information regarding significant investigations into competition and mergers. Both the EU and the UK will coordinate their efforts when necessary, even as maintaining the confidentiality of shared information. However, the sharing of confidential data requires the consent of the companies involved before being disclosed to competition authorities.
Statements from Officials
Vice President of the European Commission, Teresa Ribera, emphasized the importance of renewed collaboration, stating that the agreement represents a desire to work together and demonstrate a commitment to cooperation after Brexit. She highlighted the uniqueness of the agreement, noting it includes all 27 national competition authorities of the European Union – a feature not present in other EU competition cooperation agreements.
British Business and Trade Minister Peter Kyle added that the agreement will lead to better information exchange, more coordinated investigations, and the prevention of harmful mergers that could negatively impact consumers and markets. He framed the agreement as a step towards deepening the strategic partnership between the UK and the EU, fostering sustained economic growth and establishing the UK as a “trusted European partner.”
Ratification Process
Following the signing by EU and UK executives, the agreement must undergo a ratification process. Within the EU, this requires approval from the Council and Parliament. The Commission expressed optimism that the ratification will proceed smoothly.
Brexit Context
The agreement builds upon informal cooperation that continued after the UK’s withdrawal from the European Union. [1] It establishes a formal, transparent structure for ongoing collaboration in the realm of competition policy.
