Court Rejects Equal Protection Claims Against Gaming Commission

According to the court order issued by Judge Joshua Hawkes, the lawsuit filed by Gulfstream Park in 2025 against the Florida Gaming Control Commission (FGCC) lacked constitutional merit. Gulfstream Park argued that it is currently the sole pari-mutuel operator in Florida still legally required to hold live races to retain its casino floor license. The track contended that the state decoupled most other pari-mutuel operations—including dog racing, jai alai, and harness racing—approximately five years ago, leaving Thoroughbred permit holders under a discriminatory burden that denied equal protection.

Judge Hawkes disagreed with that framing, ruling that the live-racing requirement operates as a general law within the state’s broader regulatory framework. The court found that classifying tracks by permit type is a valid, industry-based distinction supported by legitimate government interests, which include regulating gambling, promoting tourism tied to live racing, and protecting the Thoroughbred industry specifically. The Florida Horsemen’s Benevolent and Protective Association actively intervened in the litigation to support the state’s position and back the dismissal.

Stronach Group Stalls Out in the Florida Legislature

The court setback follows a parallel defeat in the Florida Legislature, where decoupling bills backed by Gulfstream Park owner the Stronach Group have repeatedly stalled. While a version of the decoupling measure cleared the Florida House by a 77-34 vote earlier in the year, the legislation failed to secure a single committee hearing in the state Senate before the regular session concluded, effectively killing the initiative for the year.

Equine Industry Opposition and Economic Stakes

Opposition in Tallahassee has come primarily from the state’s horse-breeding and training industry. Industry representatives argued throughout the legislative debates that decoupling would devastate Florida’s Thoroughbred economy by removing financial incentives for Gulfstream to maintain a live racing program once its casino operations no longer depend on it. Equine groups framed the legislative push as an existential threat to regional breeding operations, backstretch jobs, and the broader agricultural infrastructure tied to the sport.

Racing Schedule Secure While Legal Options Remain Open

Despite the dual defeats in the courtroom and the legislature, Gulfstream Park retains the right to appeal Judge Hawkes’ dismissal, meaning the legal battle may continue in higher courts.
