Legislative Passage and Constitutional Objections

The sanctions bill reached the White House after clearing the Senate by a 98-2 vote and subsequently passing the House, making a presidential veto a non-starter. According to the White House statement issued upon the signing, the administration raised serious constitutional concerns, asserting that the bill includes “a number of clearly unconstitutional provisions” that “purport to displace the President’s exclusive constitutional authority to recognize foreign governments, including their territorial bounds.”

President Trump expressed similar reservations in an official statement following the signing. “The bill remains seriously flawed – particularly because it encroaches on the executive branch’s authority to negotiate,” Trump stated, adding that limiting executive flexibility hampers the United States in international dealings and risks driving China, Russia, and North Korea closer together.

Moscow Reaction and Trade War Warnings

The Russian government responded with immediate condemnation. Russian Prime Minister Dmitry Medvedev took to Facebook to declare that a “fully-fledged trade war (has been) declared against Russia” and asserted that “the Trump administration demonstrated complete impotence, in the most humiliating manner, transferring executive powers to Congress,” as reported by CNN.

Medvedev also stated that any hope for improved bilateral relations had ended, predicting that future ties between Washington and the Kremlin would remain extremely tense regardless of congressional lineups or the personality of the President. Prior to the signing, Russian President Vladimir Putin had already retaliatory measures, requiring the United States to cut its diplomatic mission staff in Russia by 755 employees and seizing two diplomatic properties.

Scope of the Sanctions Package

The legislation targets key sectors of the Russian economy, focusing specifically on energy and defense. Lawmakers designed the penalties in response to alleged Russian interference in the 2016 US election, as well as the annexation of Crimea and aggression in Syria. Beyond Russia, the comprehensive measure also imposes fresh sanctions on Iran and North Korea, cementing a hardline legislative consensus on foreign adversaries.
