Trump Announces New Tariffs Following Supreme Court Ruling

Former President Donald Trump expressed disappointment with the Supreme Court’s recent decision regarding his use of tariffs, but asserted he has “powerful alternatives” to continue implementing his trade policies. He criticized justices who ruled against him, alleging liberal partisanship, despite the inclusion of Republican-appointed judges among the dissenting justices.

Supreme Court Decision and Trump’s Response

Trump deemed the Supreme Court’s decision “deeply disappointing” and stated he was “ashamed” of certain members of the court for what he perceived as a failure to act in the country’s best interest. Despite the ruling, Trump maintained that his ability to regulate trade and impose tariffs was strengthened, rather than diminished, by the decision.

Alternative Authorities for Tariffs

Trump cited sections 122, 201, and 301 of the Trade Act of 1974, as well as section 338 of the Tariff Act of 1930, as alternative legal authorities for imposing tariffs. Section 122 of the Trade Act of 1974 allows for tariffs to address trade deficits, but these are capped at 15% and limited to 150 days.

New Executive Order and Tariff Implementation

Trump announced his intention to sign an executive order to maintain existing tariffs under these alternative authorities. He specifically mentioned a planned “10% global tariff,” in addition to existing national security tariffs under Section 232 and Section 301. He stated that these existing tariffs would remain “fully in place, and in full force and effect.”

Further Investigations

The former president also indicated that his administration would initiate several Section 301 investigations, along with other investigations, to protect the country from what he described as “unfair trading practices” by other countries and companies.
