U.S. To Begin Billions in Tariff Refunds After Supreme Court Ruling
A U.S. Trade court judge has ordered the government to begin issuing refunds – potentially totaling billions of dollars – to importers who paid tariffs later deemed illegal by the Supreme Court. The ruling stems from a challenge to tariffs imposed by the Trump administration under the International Emergency Economic Powers Act (IEEPA).
Judge Orders Expedited Refund Process
Judge Richard Eaton of the U.S. Court of International Trade in Manhattan directed Customs and Border Protection (CBP) to finalize the cost of bringing millions of shipments into the U.S. Without assessing the invalidated tariffs, and to issue refunds with interest. The process of finalizing entry costs typically occurs around 314 days after merchandise enters the United States, a process known as liquidation. Eaton instructed CBP to complete this process for affected shipments without applying the tariff, triggering a refund. “Customs knows how to do this,” Eaton stated during a court hearing, noting the agency routinely issues refunds when importers overpay duties.
Supreme Court Decision and Legal Challenges
The Supreme Court ruled last month that the Trump administration had overstepped its authority by imposing the tariffs under IEEPA, finding that the power to set tariffs rests with Congress. Yahoo Finance reported the ruling specifically impacted tariffs imposed on nearly every other country.
Following the Supreme Court’s decision, approximately 2,000 lawsuits were filed with the trade court seeking refunds. Judge Eaton has stated he will be the sole judge presiding over these tariff refund cases.
CBP Faces Logistical Hurdles
CBP has acknowledged the scale of the task is “unprecedented,” potentially requiring manual review of over 70 million entries. The agency initially requested up to four months to assess its options for processing refunds. However, Judge Eaton has scheduled a hearing for Friday to receive updates on CBP’s refund plans.
Potential Refund Amount
The U.S. Government collected more than $130 billion in the tariffs that were later deemed illegal. Estimates suggest potential refunds could reach $175 billion, according to calculations by the Penn Wharton Budget Model, as reported by WishTV.
Implications for Importers
More than 300,000 importers are potentially eligible for refunds. Many smaller businesses are hoping for a streamlined process to receive reimbursements, expressing concern about the cost and complexity of pursuing refunds through litigation or a lengthy administrative process.
Trade lawyer George Tuttle stated, “There should be no impediment to CBP issuing refunds.”
