Years of Uncertainty Took a Toll on Suspect, leading to Case Dismissal

A recent court ruling revealed a case dismissed due to excessive delays by the Public Prosecution Service (OM). The ruling, originally made over two years ago, was only recently made public due to an internal error – and had not been requested by anyone.

According to the ruling, the court determined the OM took far too long to bring the case to trial, especially considering the suspect’s cooperative attitude. The incident occurred 6.5 years prior to the court’s decision in late 2023.

The prolonged threat of prosecution significantly impacted the suspect, who was 47 at the time of the incident and is now in his mid-50s. This led the court to declare the OM inadmissible,meaning the case was not heard and the suspect received no punishment.

The court also noted that the case appeared relatively straightforward, aided by available camera footage, and should not have taken such a long time to resolve.

The case came to light when lawyer Bart Swier noticed the publication on rechtspraak.nl. He described it as a fitting tribute to the late Simeon Burmeister, the suspect’s former lawyer, who has since passed away.
