Apple Faces Growing Scrutiny Over App Store Practices

Apple finds itself under increasing pressure from regulators and consumers alike, facing investigations and lawsuits concerning its App Store practices and privacy policies.

German authorities are scrutinizing Apple’s implementation of its App Tracking Transparency (ATT) feature, launched in 2021. While ATT requires apps to obtain explicit user consent for tracking activity across apps and websites, the German Federal Cartel Office (FCO) suspects Apple may be exempting its own apps from these rules, creating an unfair advantage.

Judge Wolfgang Kirchhoff, presiding over a recent court hearing, indicated a willingness to side with the FCO, suggesting potential stricter oversight of Apple’s App Store practices. Apple’s legal team, however, argues that European competition authorities might reach a different conclusion and has requested consultation.

Adding fuel to the fire, the U.S. Justice Department, joined by 16 state attorneys general, filed a civil antitrust lawsuit against Apple. The lawsuit alleges Apple monopolizes smartphone markets through its App Store, stifling competition and harming consumers.

These legal battles come amidst Apple’s efforts to promote user privacy. Apple’s ATT feature, lauded by privacy advocates, resulted in over 90% of iOS 14.5 users opting out of app tracking, according to recent studies. However, critics argue Apple’s actions prioritize user privacy selectively, potentially benefiting its own products while harming competitors.

These investigations highlight the growing scrutiny Apple faces globally regarding its App Store policies. Similar concerns have been raised in other jurisdictions, including the United States, where the Supreme Court recently rejected a key antitrust challenge to Apple’s App Store.
