Dublin Businessman Faces Demolition Order for Unauthorised Beachfront Extension

A businessman in Sutton, north Dublin, is facing a court order to demolish an extension built at his beachfront property after a judge ruled the development unauthorised. Philip Farrelly, the owner of the property at 10 Burrow Road, has also been directed to restore the land within a specified timeframe.

Planning Dispute and Court Ruling

Judge John O’Connor of the Circuit Court ruled in favour of Fingal County Council, ordering the demolition of single- and two-storey extensions, including a sunroom, constructed around Farrelly’s home. The council had initially issued an enforcement notice in March 2020, requiring the removal of the unauthorised structures within four months, but initiated court action in November 2024 after the notice was not complied with. The judge has ordered the demolition to be completed within eight months, with a further six months allotted for the restoration of the land with topsoil and grass seed, or other materials approved by Fingal County Council. Irish Times

Proposed Plan Rejected

Oisín Collins SC, representing Farrelly, presented a plan to the court that aimed to meet the council’s demands through partial demolition, avoiding more drastic measures. Though, this plan, developed by a planning consultant, was rejected by Fingal County Council on the grounds that it would require planning permission, which the council was unwilling to grant outside the standard regulatory process. The dispute dates back to 2019 when Farrelly demolished an existing extension and replaced it with a larger one without obtaining the necessary planning permission.
