Erin Patterson appeal dismissed and sentence lengthened to life in prison

Erin Patterson will spend the rest of her life in prison without the possibility of parole after the Victorian Court of Appeal dismissed her attempts to overturn her convictions and instead lengthened her sentence. The 52-year-old watched Friday’s ruling via video link from the Dame Phyllis Frost Centre, dressed in a royal blue jumper and glasses.

Victorian Court of Appeal Rejects Conviction Challenges

Patterson had sought to quash her 2025 convictions on three counts of murder and one count of attempted murder, arguing she suffered a substantial miscarriage of justice during her high-profile trial. Her defence team presented seven grounds of appeal, pointing to what they termed a catastrophic decision to sequester jurors in the same hotel as the lead detective and describing the cross-examination she faced as unfair and oppressive. Lawyers also argued that the trial judge wrongly excluded certain evidence regarding foraging and that the prosecution’s closing address introduced an impermissible motive.

The court dismissed all grounds of appeal. The court found that while housing jurors in the same hotel as investigators was highly undesirable and plainly unfortunate, there was no basis to believe the jury had been contaminated or failed to reach its verdict according to the law.

Prosecution Appeal Removes Non-Parole Period

While upholding the convictions, the appeal judges agreed with Victoria’s Director of Public Prosecutions, Brendan Kissane KC, who argued that Patterson’s original 33-year non-parole period was manifestly inadequate. Trial judge Justice Christopher Beale had originally set the 33-year term, which would have allowed Patterson to apply for parole in 2056 at approximately 82 years of age.

The Court of Appeal ruled that setting a non-parole period was entirely inappropriate given the nature of the crimes. This offending was extraordinarily cold and calculated and stands to be denounced in the strongest terms, the judges stated, describing the acts as a cruel breach of trust against members of her extended family.

Patterson is now the first Victorian woman, and only the second woman in Australian history, to be sentenced to life without parole. The first was Katherine Knight, who was jailed in 2001.

Lethal Beef Wellington Lunch in Leongatha

The convictions stem from a lunch hosted by Patterson at her home in Leongatha, regional Victoria, in July 2023. Patterson served individual beef Wellingtons laced with deadly death cap mushrooms to her guests.

Don and Gail Patterson, both 70, and Gail’s sister Heather Wilkinson, 66, died from multiple organ failure on August 4, 2023, following the meal. Heather’s husband, Ian Wilkinson, fell seriously ill but survived. The appeal justices noted that Patterson’s intent to murder persisted for nearly three weeks, spanning from the initial invitations through the meal and subsequent weeks of deception while her victims suffered.

Next Legal Steps and Deadline for High Court Appeal

Patterson retains 28 days from the date of the ruling to consider whether she will take her fight to the High Court of Australia. Court orders anticipate any special leave application being filed by November 27. If she chooses not to file, or if the High Court refuses the application, Friday’s decision remains final, permanently removing any prospect of release.
